People being able to seize the Commission of Over-indebtedness
The opening of the procedures is reserved for the treatment of the situation of over-indebtedness of the natural persons, characterized by manifest impossibility for the debtor to make in good faith with the whole of its nonprofessional debts.
In other words, four conditions must be joined together to seize the commission:
1 - to be a natural person,
2 - to be French domiciled in France or abroad or foreigner resident in France
3 - to be in good faith,
4 - to be in impossibility expresses to face the whole of its nonprofessional debts contracted near the creditors established in France,
People not being able to approach the commission concerning over-indebtedness
- professional debtors likely to be the subject of a collective procedure of payment of their liability
- liberal professions for the debts caused within the framework of their professional exercise.
Particular cases
(of the managers of limited liability company and certain independent or paid activity)
The manager of a limited liability company in compulsory liquidation can profit from the procedures of the treatment of the over-indebtedness if it is not noted that the Bankruptcy court filed in its opposition proceedings to proceedings bankruptcy or pronounced the personal bankruptcy (Cass. 1st Civ 23.03.1994, Bull.civ.I, n° 112).
In the same way, certain auxiliaries of trade such as: V.R.P., sales representatives, commercial visitors, real canvassers, paid insurance agents of their company, can profit from the procedures of treatment of the over-indebtedness.
Note: The right to seize the commission is reserved to the debtor, it is not granted to the creditor.
Bona fide
Only the debtors in good faith can profit from the procedures prescribed by the L.331-2 article of the Code of Consumption.
The debtor seizing the Commission is supposed to be in good faith, it is up to the creditor to call upon the bad faith of its debtor and to bring back the proof of it.
Are regarded as debtors insincerely by the Judges:
- the people who knowingly made false claims or given of the inaccurate documents in order to obtain the benefit of the procedures envisaged by the Code of Consumption (Cass. 1st Civ 11.10.1994, Bull.civ.I n° 288)
- the people who diverted or dissimulated or tried to divert or dissimulate whole or part of their goods,
- the people who without the agreement of their creditors or the judge, worsened their debt while subscribing of new loans or proceeded to acts of provision of their inheritance during the execution of the plan or the course of the procedures.
