Procedures of execution in progress
When that you seize the Commission or before the sasine of the Commission you can be the subject of measurements of execution diligentées by one or more of your creditors.
It acts in particular:
of command of usher for purposes of seizure-sale,
of seizure on your remunerations
of seizure attribution of your bank account
of seizure of property etc…
It is important to announce to the Commission which you made the object of continuations so that it possibly can, to request the suspension of the continuations in progress near the Judge of the Execution.
The suspension of measurements of execution
The beginning of the procedure, the Commission can request to the Judge the Execution or from the Judge of the seizure of property to suspend the execution of decision of judgment to pay.
The request for suspension aims to prevent that during the procedure, and in particular during the phase of development of the plan, the situation of the debtor is irremediably compromised by measurements of distraint.
The request for stay of execution must be limited to the only procedures in the course of execution and the continuations putting in danger the development of a recovery package.
Only the Judge of the Execution can suspend measurements of execution in progress if the situation of the debtor requires it.
Authorized duration of the suspension:
The suspension could be marked only throughout procedure of treatment of over-indebtedness and will not be able to exceed:
- is one duration one year,
- the approval of the conventional plan
- is one duration going until the expriation of the time have the debtor lays out to ask recommendations the commission in the event of failure of the plan. In this case the suspension will take effect until the day when the recommendations will have executory force.
Note: The suspension decision of measurements of execution taken by Juge of the Execution is not likely of call.
Effects of the suspension:
The suspension decision of measurements of execution temporarily prohibits creditors to continue their continuations.
The suspension decision of measurements of execution stops the opinions with third holders delivered less than two months before the notification of the ordinance of suspension of the mesurs of execution and stops the seizures attribution in the course of validation as well as the seizures of personal property or real (Law of July 29, 1998).
Of course, the debtor exchanges some cannot in no case to worsen his situation, and besides the judge formally prohibits to him to regulate credits other than the food credits (compensatory alimonies, services etc…), to give guarantees or safeties (guarantee, mortgage etc…)
Notice 1: the suspension decision of measurements of execution by no means prevents the creditor to take his precautions and to obtain an executory title (judgement or ordinance) by knowing perfectly that it will be able to carry out it only later on.
The suspension of the continuations does not make obstacle with the execution of a decision of expulsion of its housing of the debtor (Cass. 1st Civ. 30/05/95, Bull. Civ I n° 228)
