To inform itself the purchase before
Before acquiring a good or a performance of service, the consumer must have been informed on the prices, the quality and the particular conditions of the sale which is proposed to him.
This transparent, sincere and honest information on the products and the services is envisaged by the right of consumption (Code of consumption, Article L. 113-3) and this, as well before the signature of the contract as in the contents even of this one.
Information on the prices
The abrogation of the ordinances of the 30/6/1945 relating ones to the price of the products and the services, which made it possible the administration to constantly intervene and in all the sectors to fix the prices, and their replacement by the ordinance No 86-1243 of 1/12/1986 relating to the freedom of the prices and the competition now in force and integrated in the Commercial law, involved a fundamental modification concerning the regulation of prices.
In addition, the Code of consumption envisages provisions obliging any professional to inform the consumers on the prices and the conditions of sale of the products and the services which it markets.
The principle of the freedom of the prices applies to all the goods, products and services offered to the sale by all the economic operators, who it is about the price of the industrial products or the tariff of the services rendered to the consumers, who they are public (public parks of parking, for example) or private.
Administration with the possibility of regulating by decree, as a Council of State, the prices of certain branches of industry for reasons drawn from the general interest (tariffs of the races of taxis, tariffs the SNCF etRATP, rents of the beams with use of dwelling of the free sector in Paris region, price of gas and electricity…).
It returns to any consumer informed to make play competition and to confront the estimates or the prices of the professionals between them to optimize his act of purchase.
The publishing of the prices of the goods and the services constitutes one of the basic principles of commercial competition and the protection of the interests of the consumer.
Under the terms of the article L. 113-3 of the Code of consumption, any information on the prices of the products or the services offered to the sale by a professional must reveal, whatever the support used (marking, labelling or others), the total sum which will have to be actually paid by the consumer. This sum must be expressed in euros since the 1/1/2002.
The selling price must reveal the possible additional costs with the load of the consumer (the amount of the expenses of delivery or sending for example)
This provision aims at putting the consumer safe from any surprise as for the amount of the total expenditure which it will have to support for the acquisition of the product or the supply of the proposed service.
Rules of labelling
Products exposed to the sight of the public
The price of the market products with the detail and exposed to the sight of the public (window, display or shelves) must be the subject of a marking by sign or a readable and accessible labelling. Information must appear in such a way that the consumer does not have to enter the store to read it or get information (Stopped no82-105/A of the 10/11/1982, Art. 2 and 5)
This obligation applies to all the spot of sale which it is of a store, a fair or a living room. The products of occasion do not escape this principle. On the other hand, the balanced articles are fixed with particular rules
The rules of the labelling of the price apply to all the prepackaged products (food or not). But for the latter, the salesman must in parallel indicate a price to the measuring unit (with the kilogramme, with the liter) (Decree no82-105/A of the 10/11/1982)
